Frontier Heart Services - Terms & Conditions

The ‘Frontier Heart Services’ (referred to as “Services”) is a technology-enabled service designed and offered by Fourth Frontier Technologies Private Limited (hereinafter referred to as “Fourth Frontier,” “we,” “our” or “us” for the sake of brevity) to enhance your use of the Frontier X/X2. As part of the Lite Services, our team of experts will bring you personalised recommendations and insights, by reviewing and analysing the data captured on your Frontier X/X2. The terms & conditions set out below (the “Terms”) apply to your access and use of the Lite Services. For the purposes of these Terms, the term ‘Services’ includes within its purview:

The Services;
Fourth Frontier’s mobile application (the “App”);
Fourth Frontier’s website (the “Website”);
all related products (the Frontier X/X2)

The overall scope of the Program is to create an interactive solution designed to engage users and provide meaningful and relevant health information to allow users to get a better understanding of the data recorded on the FrontierX/X2. The Program enables you to gain access to qualified professional experts from our team to help you understand the data recorded on the Frontier X/X2.

As part of the Lite Services, you will be provided with two options:

One-time Session (20 minute session)

Frontier Heart Lite (correspondence through email primarily)

The One-time session includes among other things, the following:

A basic informational form filled by the user with goals and key details about their overall heart health and fitness. In case there are any contraindications to safe exercise, this detail will be mentioned as well.
Our coaches/ specialists will check the users familiarity with the Frontier X/X2 and if required, provide a quick overview of the manner in which the Frontier X/X2 is to be used
The coaches as part of the one time consultation will provide education around heart health and exercise. Any questions around the metrics measured on the Frontier X/X2 may be asked during such consultation.

During the one time consultation, which as mentioned above will be a 30 minute session with a coach/ specialist, the following may be discussed to a reasonable extent:

Syncing data and viewing ECG
Live stream
Baseline resting Heart rate and heart rate variability
Age related heart rate zones and safe exercise zones
Breathing rate and RPE
Cardiac strain
Other rhythm and trends

Please note that as part of the one time consultation, the users shall not be provided with an exercise plan. The insights and recommendations given during the session are for informational and educational purposes only and at no time should be construed as diagnostic or treatment advice.

Frontier Heart Lite

The Frontier Heart Lite Service requires the user to submit a form with basic information around general health and fitness for our coaches to determine fitness levels and readiness to exercise. The information provided by way of this form should be, to the extent reasonably possible, accurate and complete.
The variation of the Lite Services includes an introductory video call with the users with the intent of learning about the user basis the information provided to a greater degree.
Subsequent to the introductory call, the users will receive a weekly email from our coaches with insights in relation to the data being captured on the Frontier X/X2
In the event a more detailed analysis is required, a coach on the Lite Service may suggest a video call or booking a one-time session

The general terms of use for products and services offered by Fourth Frontier (the “General Terms of Use”) and Fourth Frontier’s privacy policy (the “Privacy Policy”) shall form a part of the Terms. In the event there is any conflict between the Terms and the General Terms of Use, the Terms shall prevail.

For clarity, please note that, despite the description above, the Terms shall not be applicable to the Website, the App, the products and services provided by Fourth Frontier, to the extent offered or accessed other than as part of the Lite Services, and shall be governed solely by the General Terms of Use and the Privacy Policy.

You hereby agree and acknowledge that by purchasing, subscribing to, or obtaining, in any manner or form, access to the Services, or accessing the Website, the App or creating a Fourth Frontier Account for the purposes of purchasing, subscribing to, or obtaining the Lite Services, you accept and agree to be bound by the Terms, including any amendments to such Terms.

i) Effectiveness

These Terms are effective as of 18th July 2022, and any amendments to such terms shall be effective as of the date these Terms are updated to reflect such amended Terms and posted to the Website.

ii) Your Orders

Fourth Frontier offers the Lite Services on its Website and App. To order, subscribe to, purchase or obtain the Services from Fourth Frontier, you may do so on our Website. Any order submitted is subject to acceptance from our end. An agreement is concluded upon acceptance by Fourth Frontier by way of an order confirmation of which you will be notified via email. Fourth Frontier reserves the right to reject any order in whole or in part. The Services are subject to payment. The prices for the both variations of the Lite Services are as indicated on our Website and App. The prices will include any local sales taxes, other taxes, and government levies, if any, associated with the order that you are legally required to pay. Prices are subject to review and change from time to time and Fourth Frontier reserves the right to make these changes but it will not affect any order for the Services made prior to the date of the change.

All orders must be paid for through the payment service as made available by Fourth Frontier. In the event that collection through the payment service fails, Fourth Frontier will invoice you by mail for the amount payable, which must be paid by check or credit card within a period of 7 (seven) days from the date of invoice.

iii) Consent to Receive Email Communications

As a condition to accessing or using the Lite Services, the App, and certain other aspects of the Lite Services, you must provide us with your email address and any other means of communication to enable the Fourth Frontier team to communicate with you as and when necessary. By participating in the Services, you agree and consent to our communicating with you via email, push notifications, voice calls and other electronic communications that relate to the Services.

iv) Limitations regarding Medicine and Medical Treatment

The Lite Services enable users to interact with our experts and support teams. Our coaches and experts might have different opinions on certain physiological conditions or symptoms. This does not mean that our team of experts is at fault, it is normal for experts to have differing views from time to time. Please note that we do not provide any medical advice or medical treatment. Any information provided by our experts are for informational purposes only and should not be used for diagnosis or treatment of any medical condition. Do not use the Lite Services as a substitute or replacement for consulting with your physician or other healthcare provider, and do not disregard professional medical advice or delay in seeking it because of any information received in connection with our Lite Services. We are not responsible or liable for any advice, course of treatment, diagnosis, or any other information, services or products that you may obtain from unaffiliated third parties in connection with or as a result of using these Services.

v) No Emergency Services

These Services are meant for non-emergency purposes only. Our Services do not intend to cover within their purview any medical emergencies whatsoever and do not include any time critical communications with any type of hospital, law enforcement agency or any kind of emergency or time-critical services. Please bear in mind that our Services do not replace your personal healthcare care providers or any other emergency assistance.

vi) Indemnity

You hereby agree to indemnify, defend, and hold harmless Fourth Frontier, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including, without limitation, attorneys' fees, arising from or relating in any way to your use of and/or your conduct in connection with Products, Services, Apps and your conduct in connection with other users, or any violation of these Terms and Conditions, any law or the rights of any third party.

vii)Limitation of Liability
Fourth Frontier’s total liability arising out of or in connection with these terms or from the use of or inability to use the Fourth Frontier Lite Service shall not exceed the amounts you have paid to Fourth Frontier for use of the Lite Services or one hundred dollars ($100), if you have not had any payment obligations to Fourth Frontier, as applicable.

Notwithstanding any of the above or anything else contained in these Terms and Conditions, the Company shall not be held liable for your death or personal injury in the event that such death or personal injury is resulting from your own negligent or wrongful acts/ omissions.

vii) Breach of the Terms

Fourth Frontier, at its sole discretion, reserves the right to immediately terminate your account, or limit your use of all or any part of your account and / or the Services if:

you fail to adhere to or breach the provisions of these Terms; or
collection of payment for your Services should fail after a second attempt.

viii) Governing Law

These Terms and any disputes related thereto or to the purchase and use of the Lite Services are subject to the laws of India. The courts in Bangalore, Karnataka shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, where Fourth Frontier is headquartered. This clause shall not affect your rights under mandatory local law, including the right, where applicable, to bring any dispute or claim arising out of or in connection with these in the courts of your home jurisdiction.
