Early Access Terms

These terms are entered into by and between Fourth Frontier ("Fourth Frontier") and the user ("User") who opts to enable certain wellness metrics with their Frontier X Plus device (“Device”), Services, and the App.

1. Purpose
This document outlines the terms and conditions for the user's access to and use of additional features ("Early Access Features"). By signing these terms, the user acknowledges and consents to the terms herein and understands that these Early Access Features are provided for informational purposes only.

2. Non-FDA Cleared Features
The user understands and agrees that the Early Access Features have not undergone the clearance process by the U.S. Food and Drug Administration (FDA). As such, these features and any data they provide are not intended for medical, diagnostic, or clinical use. Certain features of the device, while not included in the Device's FDA clearance, are intended solely to promote a general state of health or wellness. As such, they qualify under the FDA CDRH’s General Wellness Policy for low-risk devices (see 'General Wellness: Policy for Low-Risk Devices', Category Two, pages 4–5). The user shall not use these features or their outputs to diagnose, treat, or prevent any medical condition.

3. Medical Disclaimer
The Early Access Features are not a substitute for professional medical advice, diagnosis, or treatment. The user agrees that they will consult with a qualified healthcare professional before making any decisions related to their health based on data from the Frontier X Plus, including from the Early Access Features. Fourth Frontier does not provide medical advice, and the user assumes all responsibility for their health and well-being.

4. No Warranties
The Early Access Features are provided "as is," without any warranty of any kind, whether express or implied. Fourth Frontier does not guarantee the accuracy, reliability, or completeness of the data generated by these features and disclaims all liability for any errors or omissions.
